Terms of Service

1. Purpose

These Terms of Service (the « Terms ») govern access to and use of the « BornToFan » platform service (the « Service »), operated by [Company Name], a company registered with company number [Registration Number], with its registered office at [Full Address] (the « Operator »).

The Service is a platform for sharing and monetizing video content intended exclusively for an adult audience (18 years and older). Access to the Service implies unreserved acceptance of these Terms.

2. Access to the Service — adult audience

The Service is strictly reserved for persons of legal age (18 years and older). By accessing the Service, the user declares and warrants that they:

  • Have reached the age of majority in their country of residence (at least 18 years old);
  • Are legally permitted to access and view pornographic content in their country;
  • Are accessing the Service for personal and private use only, without making it available to minor third parties.

Age verification is implemented from the first visit. In case of doubt, the Operator may require additional documentary verification in accordance with applicable laws (ARCOM in France, UK Online Safety Act, etc.).

3. User account

Registration is free. The user undertakes to provide accurate information and to keep it up to date. They are solely responsible for the confidentiality of their credentials. Any activity carried out from their account is deemed to have been performed by them.

4. Creator status — mandatory KYC

To publish content on the Service, the user must request Creator status. This status is subject to an identity verification (KYC) procedure which includes:

  • Submission of a valid official ID document;
  • A verification selfie with the said ID and a handwritten note;
  • Confirmation that the Creator and any person appearing in their content is of legal age.

The Operator stores these documents in accordance with legal requirements (in particular 18 U.S.C. § 2257 where applicable — see 2257 Statement) and for the periods defined in the Privacy Policy.

5. Prohibited content

The following content is strictly prohibited on the Service, without exception:

  • Any content involving or appearing to involve a minor (CSAM) — zero tolerance, immediate report to NCMEC and the competent authorities;
  • Any non-consensual content (including deepfakes, stolen content, revenge porn);
  • Any depiction of real sexual violence, bestiality, necrophilia, or any act that is illegal in the Operator's country;
  • Impersonation, doxing, harassment;
  • Spam, misleading content, pyramid schemes;
  • Any content infringing third-party copyrights or trademarks.

The Operator implements moderation combining automated analysis (CSAM hash scanning, AI detection) and human review. Any reported content is subject to priority review.

6. Intellectual property of content

The Creator retains all intellectual property rights in the content they publish. They grant the Operator a non-exclusive, worldwide license, transferable to technical subcontractors (CDN, transcoding), for the duration necessary to operate the Service.

The Creator warrants that they have all the necessary rights in the published content, and that they have obtained written consent from any identifiable person appearing in it.

7. Monetization

The Creator may monetize their content according to the subscription plan they have purchased (Starter, Pro, Max). BornToFan commissions and available features are detailed on the Creator subscription page.

Creator earnings are paid out via a third-party payment provider (Stripe Connect) after KYC verification. The Operator retains its commission and pays the balance to the Creator on the indicated schedule (weekly payouts from €50).

The Creator is responsible for declaring and paying taxes and social contributions related to their earnings in their country of residence.

8. Moderation, sanctions and account deletion

The Operator reserves the right, at any time and without notice, to:

  • Remove content that does not comply with these Terms;
  • Temporarily suspend an account;
  • Permanently terminate an account in case of serious violation (in particular illegal content);
  • Freeze pending earnings as part of an investigation.

The user may delete their account at any time from their dashboard. This action results in the deletion of their personal data within the time frames and conditions set out in the Privacy Policy. Some data may be retained to meet legal obligations (in particular KYC, 2257, accounting).

9. Liability

The Operator makes its best efforts to ensure the availability of the Service but cannot guarantee uninterrupted operation. Its liability cannot be engaged in case of interruption for maintenance, force majeure, or failure of a third-party provider (host, CDN, payment processor).

The Operator acts as a host within the meaning of Article 6 of the French LCEN law of June 21, 2004 and cannot be held responsible for content published by users, provided that such content is promptly removed after effective notification.

10. Reporting illegal content

Any manifestly illegal content may be reported via the « Report » button present on each video, or by email at [abuse@example.com]. Reports concerning minors are handled urgently and transmitted to the competent authorities.

11. Modifications to the Terms

The Operator may modify these Terms at any time. The applicable version is the one in force at the time of connection. Substantial modifications are notified to users at least 30 days before they enter into force.

12. Applicable law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall, in the absence of an amicable resolution, be submitted to the competent courts of [Registered office city].
