18 U.S.C. § 2257 — Record-Keeping Compliance Statement

Statement

All models, actors, actresses, and other persons that appear in any visual depiction of actual sexually explicit conduct appearing on, or otherwise contained in, this website were over the age of eighteen (18) years at the time of the creation of such depictions.

All content on this site (« BornToFan », the « Site ») is compliant with 18 U.S.C. § 2257 and 28 C.F.R. § 75 record-keeping requirements where applicable.

Content uploaded by users (Safe Harbor / Exemption)

Certain content displayed on the Site is uploaded by independent third-party content creators (« Creators »). With respect to such user-generated content:

  • The Site, as operator, qualifies for the exemption set forth in 28 C.F.R. § 75.7(d) and § 2257A (where applicable) for activities limited to the transmission, storage, retrieval, hosting, formatting, or translation of communications without selection of content.
  • Each Creator who uploads sexually explicit content to the Site is required, prior to publication, to certify under penalty of perjury that all persons depicted are at least eighteen (18) years of age, and to provide the Site with copies of government-issued identification documents establishing the age and identity of every performer.
  • The Creator is the primary producer (« primary producer ») of such content within the meaning of 28 C.F.R. § 75.1(c) and remains responsible for maintaining the original records as required by law.
  • The Site maintains copies of the identification documents and consent records collected from Creators for a period of not less than seven (7) years from the date of the last publication, in compliance with secondary producer obligations where applicable.

Computer-generated, animated and fictional content

Some content on the Site may consist of computer-generated, animated, cartoon, illustrated, or otherwise non-photographic depictions. Such content does not depict actual human beings engaged in sexually explicit conduct and therefore falls outside the scope of 18 U.S.C. § 2257. Notwithstanding, the Site prohibits any such depiction of minors or any character appearing to be a minor.

Reporting concerns

Any concerns regarding content that may violate 18 U.S.C. § 2257, child sexual abuse material (CSAM), or any other applicable law should be reported immediately to:

The Site enforces a strict zero-tolerance policy against CSAM and any content involving minors. Such content, when identified, is immediately removed, reported to the relevant authorities, and the responsible account is permanently terminated.
